1. What is GDPR?

The European Union’s General Data Protection Regulation (GDPR) protects the fundamental right of individuals in the European Union (EU) to privacy and the protection of personal data. The GDPR includes strict requirements that strengthen and harmonize data protection, security, and compliance standards.

2. Who must comply with the GDPR?

GDPR applies to all EU-based organizations and those organizations, whether based in the EU or not, that process the personal data of EU-based individuals in connection with the provision of goods or services to EU-based data subjects or the monitoring of behavior within the EU. Personal data is any information relating to an identifiable or identified natural person, such as names, email addresses, and telephone numbers.

3. Does SMARTFENSE act as a data controller or data processor?

Depending on the type of relationship you have with SMARTFENSE, it could be in the role of data controller or data processor.

SMARTFENSE as data processor: when clients use SMARTFENSE’s services to process personal information, SMARTFENSE acts as data processor. For these cases, SMARTFENSE provides an addendum called Data Processing Agreement (DPA) under the General Data Protection Regulation that incorporates SMARTFENSE’s commitments as data processor. This agreement includes the contractual clauses necessary for the Client to prove and demonstrate to third parties that SMARTFENSE, as a service provider, processes data in full compliance with the General Data Protection Regulation.

SMARTFENSE as data controller: When SMARTFENSE collects personal information and determines the purposes and means of processing that data (e.g., a data subject’s contact details to access the service demo, or a partner’s data, etc.) it acts as a data controller. 4. What is the Data Processing Agreement?

SMARTFENSE offers its clients a contractual addendum called Data Processing Agreement (DPA), which consists of a special addendum regulating contractual clauses necessary for the processing of data required for the provision of the service can be performed in full compliance with the rules of the General Data Protection Regulation.

5. Does SMARTFENSE use data threading?

Yes, in order to carry out the provision of our services, we require the assistance of a number of data threading. A threading is a third-party data processor engaged by SMARTFENSE, which has or may have access to or process Service Data (which may contain Personal Data). SMARTFENSE uses different types of threading to perform several functions, as explained in our Data Threading Policy.

6. What does due diligence mean?

SMARTFENSE is committed to using a due diligence process by which it evaluates the security, privacy, and confidentiality practices of all of our suppliers and threading who will or may have access to or process Customer Service Data. SMARTFENSE requires that they meet obligations equivalent to those required of SMARTFENSE (as Data Processor) as set out in the Data Processing Agreement (“DPA”), including that they implement appropriate technical and organizational measures, that all their staff is adequately trained, and that they have signed the relevant NDA, among others.
